Akron Family Lawyer
Divorce, Dissolution and Annulment.
When you said “I do” you never thought about ending the marriage.
Marriage is a contract.
A marriage is a contract governed by Ohio law. There are rules you must follow and to which you are bound when you get married. They never told you about the contract when you got married but you will learn about it when you get a divorce. These rules include among others that you cannot make an agreement with your spouse AFTER you get married.
If you have reached the point where your marriage cannot continue you need to call FolkLaw.
FolkLaw receives many calls each week about disillusionment. First let me say that you can be come disillusioned about your marriage and then, if you and your spouse can agree, you can have your marriage dissolved by a dissolution.
A dissolution is an uncontested divorce. This can be accomplished by one or two attorneys or a mediation. BUT, if you cannot agree on the terms and conditions of a termination of your marriage, then you can only terminate this contract by a contested divorce.
Annulment is the erasure of your marriage.
This is available under limited circumstances and FolkLaw will explain those to you when you call. Understand that this is a very limited choice.
Personal and real property division are always best decided by you and your mate. If you cannot decide, the court will decide for you. FolkLaw will tell you that if you argue over teapots, the lawyers will own them when it is all over. Make it easy on yourself financially, don’t argue over little stuff.
Child support is a statutory calculation.
If you and your spouse can agree on an amount less than the amount dictated by the State of Ohio, then you can do that. BUT, you better be aware that the court can always come back and make one of you pay more at any time.
Beware of making spousal support agreements. Be sure that you can make these payments if you must make them at all. You need professional experienced advice BEFORE you make these decisions. Don’t act without an attorney.
One of the most often asked questions FolkLaw gets are about child custody issues.
If you are going to fight over custody, be ready for the most trying and costly endeavor in which you have ever been involved.
Child custody battles involve experts and depositions, psychological testing and require numerous hours of research, writing, and litigation. None of these actors work for free and if you decide to fight for custody, you need to know that it will be expensive.
Once you have made the decision to fight, there is no going back. If you have a dedication to this endeavor and you really believe in your cause, then the fight cannot end until there is a victor and a loser. Whether you are in a domestic relations court, family court or juvenile court, FolkLaw can help you obtain custody.
Even if you are already involved in a custody fight or already lost a custody fight, FolkLaw can provide you with alternatives.

SUPPORT
FOLKLAW gets questions all the time about Support. Child Support, Spousal Support, household bills, etc.
The Court ALWAYS has the discretion to award support based on the circumstances of the parties. Child Support is generally statutory (the law restricts the Court in some instances to order support according to the guidelines set forth in the law). Spousal support is also granted according to rules set for in the Revised Code.
Folklaw is prepared to provide you with advice and guidance in navigating the complexities of the divorce process.
